SERVE Member Restored

Local 212 has successfully represented a member in the SERVE pathway who was unjustly terminated. After spending months asserting the rights of this well respected and long-term employee, the college has agreed to remove all references to termination in the employee’s files and has made the employee whole.

An enormous amount of time and financial resources were expended by both Local 212 and the college in working toward this resolution. Had administrators simply had conversations with the employee in question prior to involving their Labor Relations division, General Counsel’s office and private attorneys in this matter, not only could the time and money have been saved, but the relationship between Local 212 and administration might not have been damaged so greatly.

An important part of the concept of just cause for discipline is that employees are given notice of management concerns and an opportunity to talk through policy concerns prior to any imposing of disciplinary action. That’s the responsibility of frontline managers, and if they fail to do so in good faith and prior to bringing in rubber stamp managers above them, the product is wasted energy and resources, as well as strained relationships.
